"desc": "述說古代婦女的婚姻地位及其法律規範，我們可從<a target=\"_blank\" rel=\"nofollow\" href=\"https://www1.ihp.sinica.edu.tw/\">中央研究院歷史語言研究所</a>特聘研究員<a target=\"_blank\" rel=\"nofollow\" href=\"https://www1.ihp.sinica.edu.tw/Fellows/Jen-der_Lee\">李貞德</a>，在其<a target=\"_blank\" rel=\"nofollow\" href=\"https://www.sanmin.com.tw/Product/index/010517691\">《公主之死──你所不知道的中國法律史》</a><span>一書中提到的北魏蘭陵長公主的故事開始。<span><br>\n</span>公主為宣武帝的姊姊，另一位主角劉輝，其家族為南朝劉宋皇室成員，因鬥爭被牽連，叛逃歸附北魏。憑著自身資源（人、財），得到當時朝廷的賞賜與封爵，維持貴族的身份。進而迎娶公主，成為駙馬。<span><br>\n</span>據載，公主好妒，處死與劉輝同房而懷孕的婢女，手段兇殘地將其開腸剖肚取出嬰兒後，塞入草料，再交給劉輝。兩人關係自此日益惡化。當時掌權的靈太后，削除劉輝爵位，命令他們離婚。</span>",

"desc": "一年後，公主意圖與劉輝復合，便託人向靈太后建言，幾番周折之下兩人終於再次成婚，駙馬應承此事是基於皇命難違，還是餘情未了，我們不得而知。但可以確定的是，即使復合，他依舊不改喜歡拈花惹草的本性。在公主身懷六甲之時與兩位平民女子有染，東窗事發後，公主一反常態選擇了隱忍，反而是身邊的女性親友紛紛為其打抱不平。<span><br>\n</span>最終兩人爆發爭執，公主落床又被踢踹導致流產，並且傷重不治，駙馬則是畏罪潛逃。",

"desc": "儘管各方角力不斷，朝堂上唾沫橫飛，仍敵不過一紙詔書，「該殺就殺，該貶就貶」（此案犯人不只劉輝，還有兩位平民女子及其兄長）。<span><br>\n</span>不過劉輝幸運地遇到大赦逃過一死，甚至在靈太后失勢後，重新獲封爵位。<span><br>\n</span>在這個案件中，清楚可知在「皇權至上」前提下，法律規定只是參考，最終還是要看上位者的心情。<br>北魏時期，由太后主政的情形頗為常見，女子的地位無形中高漲許多，但從保劉派辯駁的論述中，不難看出儒家父權為主的思想，也擁有一定的支持者（往後朝代更是日漸增長），婦女在婚姻中想要追求公道時，不分富貴貧賤，都免不了要「看夫家臉色」。",

"desc": "而在唐代，<a target=\"_blank\" rel=\"nofollow\" href=\"http://hanchi.ihp.sinica.edu.tw/ihpc/hanjieb?r3qPIoudP\">《唐律疏議》</a>中的夫妻離婚有三種情況：和離、義絕、休妻。<br>「和離」與今日的協議離婚有點相似，雙方皆可主動提起。\n\n上世紀初出土於敦煌石室的文物中有幾件唐代的「放妻書」，其用字遣詞文雅，內容則指出雙方情分已盡，無法繼續共同生活，希望能好聚好散，並祝福對方離開後能再覓良緣。<br>婦女作為「和離」提出者的記載則可以在<a target=\"_blank\" rel=\"nofollow\" href=\"https://hanchi.ihp.sinica.edu.tw/ihpc/hanjieb?c2llEwe6Q\">《舊唐書》</a>找到，如劉寂的妻子夏侯碎金，就為了照顧失明的父親而「求離其夫」。",

"desc": "「義絕」是夫妻之中有人犯了不可赦的大罪，例如：殺害、毆打對方父母。在判刑確定後，除了宣布犯事者需要受的刑罰外，還會同時強制夫妻離婚。<br>若受害者為對方的尊長，加害者受到的懲罰是男女平等的。然而，「若有毆妻，以卑故減，至死以凡人論。若妻毆夫，以尊故加」（<a target=\"_blank\" rel=\"nofollow\" href=\"https://hanchi.ihp.sinica.edu.tw/ihpc/hanjieb?r3qPIoudP\">《唐律疏議》</a>）。也就是說，當加害事件僅發生於夫妻之間時，除非傷及性命，否則女性的法律保障是遠低於男性的。<br>",

"desc": "<span>「休妻」是男子單方宣告離婚，一紙休書，內容直指妻某氏犯了「七出」之狀的某（幾）條，已不堪為人婦，故休之。寥寥數語，當家主母就成了下堂妻。<span><br>\n</span>在「心證」的解釋下，「蒸梨叱狗」都能當理由，七出根本是男子的「休妻萬靈丹」。<span><br>\n</span>不過若有依靠，或者丈夫恰好不得聖寵，要逆襲也不是不可能。唐憲宗的戶部尚書李元素就因為休妻而被罷了官，在死後才靠著同袍上書平反得以追贈。</span>\n\n此外，根據古代法律規定，在某些情況下丈夫不得休妻，包含婦女與丈夫同守公婆喪、結婚時貧賤後來富貴、妻子無娘家可歸等，統稱為「三不去」。然而，一個不受待見的妻子，即使避免了被休的結局，其處境之困窘也是昭然若揭。<br>",

"desc": "在元代，指腹為婚是被禁止的，結婚、離婚都要有契書，且不可以僅蓋手模為依據。<br>丈夫不可以因為感情不和睦而賣掉被休的妻子，當然也就不能買被別人休棄的婦人，也就是「禁斷賣休、買休」。<br>此外，元代對於「毆妻墮胎」的官員之處置十分明確，除「笞（用鞭或竹板打）三十七」外，職位也會被收回，最後降品流放，且妻子能「依法離婚」。先前提及，北魏的劉輝在毆打公主流產致死後引發了各派對判決的論戰，如果依照元代法律的話，就有了明確的判準。",

"desc": "<span>清代離婚、夫妻鬥毆的律法上大致承襲前朝。在<a target=\"_blank\" rel=\"nofollow\" href=\"https://hanchi.ihp.sinica.edu.tw/ihpc/hanjieb?BYMlemQnx\">《刑案匯覧》</a>之中，</span>有別於法典中只列法條，提供了案件始末的敘述。<span>在這些案件中，可以看見市井婦女在父權社會的壓迫下所能獲得的些許保障。<br></span>例如訂婚後丈夫不知所蹤，妻子苦候多年想要另行改嫁，已受聘禮不應追回；或如婦女被搶就被認定失貞的觀念，若犯姦婦女都可以悔過從良，則未經審視就依身份判定並不合理；又如娼婦所收養的女兒本身並無賣淫，不應有視其為不良女的無知想法。<br>\n\n<a target=\"_blank\" rel=\"nofollow\" href=\"https://hanchi.ihp.sinica.edu.tw/ihpc/hanjieb?KlYoM6mjb\">《定例成案合鐫》</a>則再度提醒世人皇權不可質疑，誥命夫人為朝廷所賜，若要將其休棄，應先上書來訴說緣由，當所封被追回後才可以「依法休離」。",
